I have been a consultant both for advanced research and as an expert witness (consulting and testifying) for intellectual property cases.
Advanced research
Faculty at R1 universities like UC Santa Cruz are typically allowed to consult a day per week. During my 29 year career as a faculty member, I often consulted with companies about difficult technical problems they were facing, typically in advanced research and product development.
Expert witness
I have been an expert witness on about a dozen intellectual property cases over the past 25 years; a complete list can be found on my curriculum vitae. Most of my work has been as a testifying expert, though many of the cases were resolved before going to trial. I have been deposed about half a dozen times, and testified in court 3 times.
I have also testified in court as a fact witness in an intellectual property case, so I have experience from that side of the process as well.
I primarily work as an expert witness for the defending side of an IP case. However, I have worked for the plaintiff in cases where both sides were small technology companies, and the plaintiff was claiming real damage from infringement based on the impact to their business. I will not consider being an expert witness on behalf of a non-practicing entity; I only consult for companies that have real products and would be impacted negatively by the outcome of a lawsuit.
